Design- Prosecution and General Information
Introduction
Federal Law No. 44 for the year 1992 pertaining to the Industrial Regulation and Protection of Patents, Industrial Drawings, and Designs was replaced by Federal Law No. 17 for the year 2002.
Registration Procedure
Once an application for design or industrial model is filed, it is examined with respect to compliance with the formalities under the design law including novelty, inventiveness and industrial application. In case of rejection, the applicant has the right to appeal to the committee within 60 days as of the date of receiving the notification of rejection.
Accepted applications are published in the Official Gazette and any interested party has the right to appeal to the Committee within 60 days as of the date of publication in the Official Gazette. In the absence of opposition, the registration certificate is issued.
A design or industrial model registration is valid for 10 years.
Annuities
The payment of annuities can be made on or before the due date at any time and for any number of years. However, annuities can still be paid during the 3 months after the due date without a late payment fee and another 3 months with a late payment fee, (the total grace period is 6 months).
